The outlook
Again Anderson.
Here is what Jaitley said in the year 2001when he was Law Minister:
“It is not the case that Mr. Anderson committed any act that led to the direct result of the leakage of gas and the consequent loss of lives and injuries.” He maintained “there is no evidence that Mr. Anderson had knowledge of design defects and violations of safety requirements, and yet he failed to take proper remedial measures.” there was no evidence to show that the parent company exercised control over the day-to-day operations and running of the Bhopal plant. In the light of this, Mr. Jaitley's note concluded that India's extradition case appeared weak. However, he added, “it will be a matter of policy to go ahead with the extradition request despite these shortcomings.”
Forgetting its own Law Minister's opinion when in power in 2001, the BJP has now decided to move a motion in the Lok Sabha on the opening day of the monsoon session to demand the extradition of Mr. Anderson.
Incidentally, Mr. Jaitley had also advised Dow Chemical in his individual capacity as senior advocate in 2006, when he was no longer in the government. He had then opined that Dow could not be held liable for the Bhopal gas leak tragedy under civil or criminal proceedings. (Excerpt from The ‘Hindu’ a leading newspaper.)
When Congress came in power in 2004 till the date of judgment in the Gas disaster case it did not otherwise react on this aspect and now all political parties without any exception are baying for blood, demanding that the government should secure the extradition of the former Union Carbide chairman, Warren Anderson, to India for trial. All the parties are ready to agitate the issue in Parliament also. Out of fear after the judgment the government has announced extra compensation of about 400 crores of rupees and rest of the compensation of about 400 crorers will be released there after. This extra compensation is without any logical rational and legal reason. Reopening of the case is another propaganda also. All political parties should explain their stand and justify what they did and show why and how they will react on the said subject.
Here is another Tamasha by M.P.Govt. It has decided to set up a Commission under the auspices of a retired High Court judge to submit a report in this behalf. This is all bogus and of no consequences. It is a political decision and judiciary is being made scapegoat by involving it to save politicians. Such commissions would yield nothing .The Commission will not be able to collect bones and even ashes of the facts in issues or relevant facts. The Chief Minister Shi Raj Singh could not dare to remove the then Collector Motising from the post of Chairman ship of a committee formed for colleges and he is getting all facilities. Same is the case with Swaraj Puri who was a member of a Tribunal and after judgment he was removed from the membership but at the same time the Central Government gave him new job. One cannot expect any positive act from the Indian democracy governed by such corrupt politicians. .
